Rule 35
Matters to be disclosed in the appeal letter

(1) When appealing in accordance with sub-section (2) or sub-section (6) of section 119 of the Act, the following matters must be disclosed:-
(a) The name of the military court which decided the decision,
(b) being a plaintiff or defendant in the original suit,
(c) Name of the case,
(d) Date of judgment,
(e) Punishment claimed in the original case, penalties, penalties, fines and penalties sustained, penalties and penalties, fines,
(f) Grounds taken in making the decision,
(g) Dissatisfied matters in the judgment, its legal basis and reason and the matter demanded in the appeal letter,
(h) if the appellant has been imprisoned or imprisoned, the date of imprisonment or imprisonment,
(i) If the penalty has been paid incorrectly, proof of when and where it was paid (j) Time-related matter.
(2) If the letter of appeal made according to sub-rule (1) appears to be as follows, it shall be registered and a copy thereof shall be given to the concerned person:-
(a) In case of penalty or fine, the same has been submitted,
(b) that the bail is in accordance with that law,
(c) Unexpired,
(d) A clear understanding of the original judgment and a copy of the original judgment has been submitted.
(3) The above appeal letter from the General Military Court and the Summary General Military Court established outside the military base can be submitted to the Military Special Court through the respective Pritna Prad Vivak branch or Bahini Prad Vivak branch.
(4) According to sub-rule (3), if an appeal letter is submitted to the Pritna prad vivak branch or the Bahini prad vivak branch, that branch shall receive such appeal letter and give it to the concerned person and send the said appeal letter to the military special court as soon as possible.
(5) In accordance with sub-rule (4), if the appeal letter is submitted to the Pritna Prad Viwak Branch or the Bahini Prad Viwak Branch, the same date will be fixed as the date of filing the appeal.
(6) The format of the appeal letter will be as per schedule-8.
